Welcome to UNDERME. These Terms and Conditions ("Terms") govern your use of our platform, where users can buy and sell second-hand clothing. By accessing or using our services, you agree to comply with these Terms.

Account Registration

To use our marketplace, you must create an account. You agree to provide accurate and complete information during registration and keep your account information updated.

Seller Responsibilities

Sellers must provide accurate descriptions and images of the items they list. Items sold must be second-hand clothing. Misrepresentation of items is prohibited.

Sellers are responsible for shipping sold items in a timely manner. Proper packaging and accurate address details must be ensured.

Sellers must accurately declare the value and nature of items being shipped internationally, and provide all necessary documentation, including customs declaration forms and invoices. Sellers are responsible for the delivery of items to the buyer. Any shipping issues must be resolved by the seller.

Buyer Responsibilities

Buyers are responsible for reading item descriptions carefully and understanding the condition of the items before making a purchase.

Buyers must provide accurate shipping information and promptly communicate with sellers if there are any issues with their order.

Buyers can cancel an order only before the seller has started the shipping process. Once the item has been shipped, cancellations are not allowed.

Delivered products cannot be returned as they are second-hand and include intimate items such as underwear.

Payments and Fees

All transactions must be completed through our platform’s payment system. Fees associated with sales and purchases will be clearly communicated to both buyers and sellers.

Sellers will be charged a 18% commission on each sale. This fee will be deducted from the total sale amount.

Customs Fees and Responsibilities

Items bought and shipped as regular purchases (not marked as gifts and valued more than $20) may be subject to customs fees, taxes, and duties. These fees are determined by the customs authorities in the destination country and are the responsibility of the buyer. Customs fees and taxes are calculated based on the declared value of the item and the applicable rates set by the destination country’s customs authorities.

Any customs fees, taxes, and duties must be paid directly to the appropriate customs authorities or the courier service upon delivery.

Both buyers and sellers must comply with all applicable laws and regulations regarding international shipping and customs declarations.

Returns and Refunds

Returns and refunds are generally not accepted due to the nature of second-hand and intimate clothing items. Buyers should carefully review the item description and condition before making a purchase.

In case of disputes, our customer support team can assist, but we do not guarantee resolution.

Prohibited Activities

Users are prohibited from:

• - Engaging in fraudulent activities
• - Using the platform for illegal purposes
• - Harassing or abusing other users

Termination and Suspension

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any prohibited activities. Such actions may be taken without prior notice.

Amendments to Terms

We may amend these Terms at any time. Users will be notified of any significant changes through our platform. Continued use of our services after changes are made constitutes acceptance of the new Terms.

Limitation of Liability

Our marketplace is provided "as is" without warranties of any kind. We are not liable for any damages resulting from the use of our platform or the transactions between buyers and sellers.

Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes arising from these Terms or the use of our platform will be resolved in the courts of the United Kingdom.
